You will receive your invoice by e-mail after the auction with details of how to take possession.

Terms and conditions

Subject to changes announced by auctioneer at time of auction, Anyone participating in the auction must abide by the following rules:
  • An auction fee of 18% applies to all purchases made on site or online.

1.

A deposit equal to 25% of the purchase price or 5% in the case of a building will be paid at the time of sale. The balance of the payment must be paid in full after the end of the auction. All payments must be made by credit card (max 1000 $), bank draft, bank transfer or Interac transfer only. Deposits on any purchases may be paid prior to the auction, and the balance of the deposit will be refunded immediately after the auction. The auctioneer reserves the right to re-auction items if the deposit is not paid before or at the time of the sale.

Federal and provincial sales taxes must be paid to the auctioneer at the time of sale. Tax-exempt buyers must provide satisfactory proof of exemption to the auctioneer. If satisfactory proof cannot be provided, buyers will be required to pay said taxes.

All items will be auctioned to the highest bidder and the auctioneer reserves the right to sell items in individual or grouped lots or "IN BLOCK", as he deems appropriate; he reserves the right to sell on behalf of a third party, on his own behalf or on behalf of others. In the event of a dispute between two or more bidders on any auction, the lot in question may, at the auctioneer's discretion, be re-auctioned and re-judged. The auctioneer sets all rules relating to the conduct of the auction, and his decisions are final and binding on all bidders.

The auctioneer reserves the right to sell under restrictive conditions and to buy on his own behalf or on behalf of others, by verbal or written proxy, all in the event of a prior sale.

All bids are finalized at the fall of the hammer or at the word "SOLD", at which point the buyer may no longer withdraw his bid. Title to the lot will not be returned until the full purchase price has been paid.

All sales are final, on the basis of "IN THE PRESENT STATE, IN THE PRESENT PLACE" "ON THE SPOT", "WITH ALL ITS FAULTS".without any conditions or warranties, express or implied, statutory or otherwise, including, without limitation, warranties or conditions of title, description, fitness for purpose, quantity, quality, merchantability, condition, location or otherwise. Pursuant to article 1732 of the C.c.Q. Talbot et Ass. Encanteur and the buyer acknowledge that all vehicles and equipment are excluded from any legal warranty of quality. No sale will be invalidated (and the auctioneer will not be held responsible) in the event of an incorrect description of an item or lot, whether in a catalog, advertisement, or otherwise, descriptions are intended to be mere guides and the buyer should not look to them for precise or complete details, buyers will be expected to rely entirely on their own inspections and investigations.

No item will be removed until paid for in full and all items purchased must be removed within three days of the auction date. The buyer will be responsible for transportation costs and, without limitation, for any damage inflicted to the environment during or as a result of removal. Buyers must comply with all environmental laws and regulations, and with all requirements made by the auctioneer regarding the removal of items, including those concerning the bonding of movers.

Where applicable, transfer documents in the possession of the auctioneer, including motor vehicle registration certificates, will be delivered to the buyer within seven days of the auction or as soon as these documents become available.

If the Auctioneer is unable to deliver an item due to fire, theft or any other reason, the Auctioneer will refund to the Buyer all sums paid by the Buyer in respect of such item and the Auctioneer shall not be liable to the Buyer for any damages arising out of or in connection with such loss, including without limitation any damages due to loss of profit.

The auctioneer reserves the right to refuse any person the privilege of bidding or being present at the auction and may cancel such privilege at any time.

11.

Time is of the essence. In the event that the buyer fails to make payment or remove the merchandise within the aforementioned time frame the buyer will forfeit his deposit, and the auctioneer may resell the item at auction, by private contract or otherwise, at the auctioneer's discretion and the buyer will be liable for the shortfall and all costs and expenses including (but not limited to) interest rates (1.5% per month or 18% per year, minimum), legal fees, removal and storage (minimum rate 5.00$/sq.ft. per month) and commissions, occasioned by such resale.

12.

No purchaser may assign, transfer or dispose of his or her rights to any item until the purchase price has been paid in full.

These terms and conditions, together with any amendments or modifications expressly made by the auctioneer at the time of the auction, constitute all terms and conditions relating to the sale of the items offered at this auction. There are no representations, warranties, terms, conditions, undertakings or subsidiary agreements other than the foregoing.
